FROM ZANZIBAR'S VUGA HIGH COURT!

 The building at Forodhani in Zanzibar housing the famous 
Silk Route Restaurant which has now been returned by the 
High Court to the two rightful owners  - one deceased 
and the other living abroad.

(Zanzibar, Tanzania)  — The building housing the famous Silk Route Restaurant and the adjacent Nakupenda Isles Safari here in Zanzibar  has today been declared by the High Court in Zanzibar to belong to two brothers, one is now deceased and the other is living abroad (Canada). 

Four years after the death of their father, the heirs of the deceased brother,  usurped the full ownership of the building and their uncle had to go to court to fight for his due share of the property.

Nakupenda Isles Safari - adjacent to the Silk Route Restaurant, both are 
housed under the same building.

After almost seven years of wrangling over the ownership between the uncle and the kids of the deceased brother, the High Court today adjudicated that both brothers jointly owned the building. This judgement came out as no surprise to many in Zanzibar, as everybody knew that the kid's uncle was the one who purchased the building in 1988 while working in Dubai.

The uncle could have fought in the court for the full ownership of the building, but never did so, as according to those near him, he wanted to keep the words that he gave to his late brother when he was alive, that they would mutually co-own the building for ever in life or in death, in spite of the fact that he (the kid's uncle) was the one who alone from his own personal resources purchased the building in 1988.

While the deceased brother's kids did know the truth, as they willingly and openly admitted during sessions with the officers of the Wakf Commission (that the property was owned by the two brothers jointly) and still disputed their uncle in court, shows how greedy the world today has become!

As they say,..."Haki ya mtu haipotei", though this happened after a grueling dog fight that left indelible scars in the families of the two brothers.

The uncle was represented in the court by Abdallah Juma Mohammed of Zanzibar’s famous AJM Solicitors and Advocates Chambers and the kids were represented by Suleiman S. Abdulla of Nassor & Associates.
