Home Affairs ministry to probe Lipumba's arrest

The Home Affairs ministry has been ordered to investigate Tuesday’s arrest of Civic United Front (CUF) National Chairman Prof Ibrahim Lipumba in Dar es Salaam to determine whether police used excessive force.
 
The order was issued by the government yesterday in parliament and is to be executed by the complainants department in the Home Affairs ministry.
The responsible minister, Mathias Chikawe said if it will be established that they used more force, disciplinary measures will be taken against them.
 
The development came in the wake of heated debate with most CCM MPs in the House supporting the police while opposition MPs remained adamant that the force used excessive force.
 
Forwarded by appointed MP James Mbatia, the motion saw bunge activities suspended twice on Wednesday and yesterday forced Speaker of Parliament Anne Makinda to demand an explanation from the government.Attorney General, George Masaju advised Parliament to stop discussing the motion but opposition members refused and insisted the debate continues.
Ruling in their favour, the Speaker okayed the debate to tarry for three minutes a ruling faulted by Singida- East MP, Tundu Lissu (Chadema) who reminded the legislators that rules and regulations of the House provide 15minutes of discussions for any tabled motion.
 
He went on to call for the resignation of Home Affairs Minister Mathias Chikawe, IGP Ernest Mangu and Prime Minister Mizengo Pinda.
"Majority of us are oppressed and tortured by the police without any reason and we should take measures immediately to make these people accountable," Lissu said.
 
"We need to have a committee that will investigate the police over allegations of killing and torturing of innocent people …” he added.
Mohamed Mnyaa (CUF) said; "The taskforce employed to deal with CUF Chairman and his followers was not necessary."
 
Leader of Opposition, Freeman Mbowe (CHADEMA) suggested that it is better for the government to investigate and take measures upon any information taken to it instead of taking it for granted.
 
"Every time we provide information to you about the police force you normally don't take any action…it is better for you to take action," Mbowe implored.
 
On his part, appointed MP James Mbatia called for amendment of the Political parties Act, Parliament Rights Act of 1988 and Services Act Cap 3, a move he says will ensure ‘this kind of problem does not occur again.’
In response, the Speaker said she will seat with her committee to discuss the said laws.
 
On the other hand, CCM MPs were in defense of the police force; "Instead of blaming the police force we need to make sure that we are abiding to rules and regulations of the country," said Said Nkumba (CCM).
 
Police in Dar es Salaam arrested Prof Lipumba and 32 other party followers on Tuesday this week allegedly for holding a demonstration without permission but were released on bail hours later.
 
The party followers were marching in memory of their collegues who were killed in Zanzibar in 2001. 
 
According to eye witnesses, before arresting Prof Lipumba and his party followers, police fired gas canisters to disperse them.
"Prof Lipumba arrived here with a letter from the Central Police Station saying the demonstration had been cancelled,” narrates a demonstrator who opted for anonymity.
 
“We disagreed with the decision because our intention is to remember our brethren more than 60 people who lost their lives in Zanzibar,” he lamented.
 
On Wednesday Prof Lipumba appeared before the Kisutu Resident Magistrate's Court in Dar es Salaam, charged with incitement contrary to section 390 and 35 of the Penal Code (Cap 16 R.E 2002).
According to the prosecution, the investigation into the case is incomplete and the case will come up for a mention on February 26, this year.
