Police testifies in CUF demo case

Kisutu Resident Magistrate�s Court
Assistant Commissioner of Police, Sebastian Zacharia yesterday alleged before the Kisutu Resident Magistrate’s Court that he asked the CUF national chairman, Ibrahim Lipumba to obey police orders prohibiting him from holding demonstrations but the latter disobeyed.
 
Before Principal Resident Magistrate, Cyprian Mkeha, Principal State Attorney Bernard Kongola said the Assistant Commissioner saw a television broadcast announcing that on January 26, this year, CUF members will stage a demonstration on January 27, 2015 at Mbagala Zakhem in Dar es Salaam.
 
He told the court that Assistant Commissioner of Police, Sebastian Zacharia sent detectives to investigate.
 
Zacharia’s colleague, Commander Simon Siro told him that that, they had all the information about CUF demonstration and assembly but the party was barred from holding the meeting.
 
He further explained  that after he  received the  information he  called  other police officers, and showed them the police order which barred the party from holding the  demonstration and assembly.
 
Zacharia said that he ordered detectives to go and investigate whether the party had obeyed the police order.He  further alleged that while in his office he  received a call from Assistant Superintendent Msuya who informed him that    CUF members were holding banners and flags  including Prof Lipumba were ready to Prof  Lipumba. 
He further claimed that after a short time Lipumba and his followers started to demonstrate.
 
Zacharia recognized Lipumba and Kamabaya because he talked to them and reminded them about the ban of the protest and the unlawful meeting from police.
 
He further added that Lipumba admitted to had received the said letter from police but said that they had already decided to demostrate and that there were people from Mbagala Zakhem who were waiting for him.
 
“When we try to prevent them, some followers start shouting and using abusive language to the police  officers. At this juncture the police cautioned Lipumba and his followers to disperse but they disobeyed the order as a result the police had no option but to arrest them.
